Richard Finley's Gristmill:
Landscape and Community Values
From the very commencement of settlement on the banks of the Calapooia River there existed forces within the valley itself that ultimately led to the psychological separation of Calapooia residents from the landscape. The incidents depicting this process are numerous, but the story of the construction of Richard Finley's gristmill on the falls of the Calapooia perhaps best shows these agents at work at a very early date. In this story, landscape plays a key role.
After arriving in the Oregon Country in the fall of 1845, John and Agnes Courtney wintered in the lower Willamette Valley. The following spring they traveled south and settled on the southern side of the Calapooia Valley on a small stream that now bears their name. With them came an entourage of immediate and extended family members, including their son John R. Courtney, who subsequently took up a claim of his own, just a few miles northeast of his parents. When John R. recorded his claim with the Oregon provisional government on 15 August 1846, he gave the following description: "640 acres of land in Champoeg County, situated on the Calapooigah river, above the Santyam, Commencing at an oak tree at the N.E. corner, thence running S. one mile to a stake, thence W. one mile to a stake, thence N. one mile to an oak tree marker, thence to the place of beginning. Said includes the falls of the Calapoiah and is held in personal occupancy. "[2]
For reasons that are not known, Courtney temporarily left his claim without making further improvements to it, even though the letter of the law required that a settler, to retain title to property, had "either personally [to] reside upon his claim himself, or to occupy the same by the personal residence of his tenant." Courtney did neither. But he also did not intentionally yield his rights to his land when he walked away from it. He had every reason to expect that the frontier custom of the "tomahawk claim" or "tomahawk law," long practiced in cis-Appalachia, protected his land from intruders.[3]
Because of the settlement nature of the early cis-Appalachian frontier, new arrivals there had for years abided by the tomahawk law, a

commonly recognized convention that flouted the letter of the law requiring occupation and improvement of claims. Under the tomahawk law, a settler, in order to hold his claim, had only to mark its boundaries by girdling a few trees. This practice allowed him freedom to move on to see if some other claim might suit him better. If he found no better site, he could always return to the earlier claim.[4]
Settlers carried the tomahawk law to Oregon. Men often left their families in the lower Willamette, sometimes even back in the Midwest, while they went ahead to find a suitable claim in western Oregon. Elias Keeney, for example, settled by himself on the Calapooia in 1847, headed to the gold-mining region of California in 1848, returned to his Calapooia claim in 1849, and then, in 1850, went to Missouri. When he returned to his land in the Calapooia, he brought a new family with him.[5]
On returning to their tomahawk claims, however, Willamette settlers sometimes found their lands occupied by people whom they considered "claimjumpers," but who in fact had every legal right to take up the technically abandoned land. Claim-jumping in the Willamette Valley frequently occurred during early years of settlement, particularly in the more heavily populated northern regions where poor land surveys, land frauds, dubious land sales, and speculation ran rampant. But in areas where effective government control did not exist, the community—particularly families, but also organized protective associations—generally rallied to support the first settler, as they had in cis-Appalachia.[6] A similar event, though with different results because of perceptions of the landscape's utility, occurred on Courtney's claim at the falls of the Calapooia in the late 1840s.
At about the time Courtney walked away from his claim on the falls of the Calapooia, two separate groups of families—who had become acquainted with each other during the migration of 1846—entered the northern Willamette Valley. The first group included James and Sarah Blakely of Tennessee and their five children and James's uncle Hugh and aunt Clarissa Brown, also from Tennessee, and at least five of their children. The other group comprised Alexander and Sarah Kirk with four children, their son William Riley Kirk and his wife and one son, and Alexander and Sarah's daughter Mary "Polly" (Kirk) Finley and her husband, Richard Chism Finley, and their two children, all from Tennessee, Indiana, and Missouri.[7]

On entering the Willamette Valley, the Blakely and Kirk parties headed south. The Finleys stopped on the Marys River on the west side of the Willamette, while the others went on until they reached the Calapooia. The morning after arriving, they surveyed the valley as far east as the falls on the Calapooia River (i.e., John R. Courtney's tomahawk claim) and decided that the little valley afforded them a suitable home. They proceeded to take up four contiguous claims near where the Calapooia River flows out onto the open Willamette prairies.[8]
James Blakely and Alexander Kirk found Isaac Courtney, brother of John R. Courtney, occupying the particular parcel of land they desired. Kirk had a special interest in the eastern portion of Isaac's claim because it straddled the Calapooia River at a ford where the developing pioneer wagon trail along the eastern foothills of the valley would probably lead farther into the southern Willamette and eventually to California. In acquiring such a claim, Kirk knew he could "control both banks of the river" where he would soon construct a toll ferry. Blakely later recounted that, "Mr. Kirk and I traded a yoak of oxen for . . . the parcel of land" Isaac held.[9] These apparently amicable relations with the Courtneys, however, soon soured.
With the Browns, the Blakelys, and William Riley Kirk entrenched in their claims, Alexander Kirk hired Isaac Hutchens to reside on his land while he returned with his family to the Marys River, where the Finleys had remained. It is likely that the Kirks, on reaching the Marys, related to their son-in-law Richard Finley—a miller by trade—the encouraging news about the falls they had found on the Calapooia, which locals described as "the best spot," "a fine site," and even "the only available spot" to build a gristmill.[10]
The Kirks and Finleys wintered on the Marys, but the following spring they headed for the Calapooia. At the time Finley entered the Calapooia, settlers in the southern and mid Willamette Valley had to travel as far north as the Hudson's Bay Company's mills at Oregon City to have their wheat ground into flour, a trip requiring about ten days. James Blakely later recalled that some spent as many as seventeen days taking wheat to the mill at Fort Vancouver, on the north side of the Columbia. For the ostensible reason that such travel was an inconvenience, a group of settlers headed by Blakely and Brown encouraged Finley to build a mill at the falls of the Calapooia on the site of John R. Courtney's claim.[11] Disregarding the tomahawk claim, they noted that

Courtney had gone away "without making any improvements [and] had no right to hold it," and they promised to "back Finley up in his claim at any cost." Finley wasted no time: on 22 April 1847 he was in Oregon City to have the claim legally recorded in his name with the provisional government.[12]
Finley returned to the Calapooia to begin to improve his claim. Just as he felled a tree for a footbridge across the river, John R. Courtney suddenly reappeared. Some versions of the story suggest that Courtney made threatening advances toward Finley, ordering him off his land. But Finley, ax in hand, was not to be trifled with. Courtney retreated to get reinforcements from his family, and Finley sent word to those settlers who had encouraged him to take the claim. Soon, two armed bands gathered at the disputed site. Finley's supporters included Blakely, Brown, Alexander Kirk, and possibly William Riley Kirk. The Courtney contingent comprised John B. Courtney, John R. Courtney, John Dunlap (Agnes Courtney's first husband's brother-in-law), and possibly Isaac Courtney.[13]
The traditional story holds that the Courtney clan did not want to sacrifice human life and so finally backed down. But it is very likely that the Courtneys realized that, although frontier tradition affirmed their superior moral position, they were legally in the wrong. Equally important in the Courtneys' decision to back down was their realization that the valley actually needed a gristmill. John Dunlap, in fact, calmed John B. Courtney, "who was very angry about the whole affair and was going to kill Finley," by assuring him that "Finley is all right and he will build a mill here long before you ever could." And Finley did (figure 3).[14]
Finley and his supporters saw the utilitarian significance of the landscape in this parcel of the Calapooia, and they were ready to take advantage of it. In this instance, utilitarian concern outweighed a vision of the land based on moral principles. As Finley's own daughter, Eliza, later pointed out, this event opened a social wound in the Calapooia community that took years to heal. But probably neither Eliza nor other Calapooia residents detected that this single instance of struggle between traditional morals of land claiming and the benefits of economic development—something that had occurred and would continue to occur on other parts of the western frontier—also opened a wound that slowly festered in the settler-landscape relationship on the Calapooia.[15]

HAYES, SETH W.
Born in Ohio in 1825; came from Iowa to Oregon in 1852, and settled near the present site of Halsey, Linn County, two years later. The town of Halsey was laid out in 1871, by the railroad company, partly upon Mr. Hayes land, and that gentleman owned property in it. He was murdered, on November 1, 1876, by Kay Neal. The circumstances of the killing were as follows: Mr. Hayes ardent temperance principles and prominence made him obnoxious to certain ill-disposed liquor dealers and their supporters. The town was incorporated in the centennial year, through the joint efforts of Mr. Hayes, Jacob Thompson, and others, who sought to extirpate the whiskey traffic. Neal sought a quarrel with Hayes, and taking him at a disadvantage, stabbed him, there being no eye-witness.
The unfortunate victim lived but a few hours. The assassin at tempted to escape, but was taken and imprisoned. When he was brought to trial his lawyers set up a plea of self-defense, but a verdict was rendered, convicting Neal of murder in the first degree.
Sentence being pronounced, the murderer was executed at Albany, on the twenty-eighth of January, 1877. This homicide constitutes, probably, the most striking event in the history of the county of Linn. Mr. Hayes was twice married, and his children numbered six, of whom five are living, viz. Daniel, S. S., Frank R., Gertrude, and Irving. The second Mrs. Hayes (formerly Miss Finlay) is now residing on a portion of the Hayes ranch near Halsey.

WILLIAM B. FINLEY. -- Among the many industrious and enterprising agriculturists and stockmen of the prosperous county of Morrow, especial mention should be made of the man whose name appears at the head of this article; because of his public spirit and breadth of mind that have led him to be a poptent factor in the advancement of the interest of the county: because of his excellent success, which he has achieved within its boundaries, being the legitimate outcome of his industry, distinguished capabilities and wise procedure: and because of his integrity and intrinsic moral worth and unsullied life of uprightness.
He is a native of the Web-foot state, being born in Linn county on April 11, 1854, to Richard C. and Polly Finley. He was educated in the district schools of his native place and there grew to manhood, remaining there for twenty-seven years of his life. At the age of nineteen he started on a farm of his own and remained there until 1881, when he emigrated to Umatilla county, settling six miles northeast from Pendleton on land he purchased from the railroad company. Here he remained for three years and then went to his present place, twenty-five miles north from Heppner, between Butter and Willow creeks, giving attention to raising wheat and horses until 1896, when he embarked in the sheep business with a flock of thirteen hundred and fifty head. His excellent ability as a stockman is manifest in that he now owns four thousand five hunderd head of stock sheep and two thousand one hundred acres of deeded land, besides five thousand acres of land leased from the railroad company. His success in this line of business is marked and excellent, and he takes rank with the leading stockmen in this land of stock raisers. His sheep are of the best grade of Merino and fine wool producers.
The marriage of Mr. Finley and Miss Hannah E. Windom, a native of California, occurred in March 1875, at Harrisburg, Linn County, Oregon, and to them have been born the following children: May Augustus, wife of Harvey E. Bartholomew, of Heppner; Arthur A.; Ralph; Claud; and Walter C. and Nellie, deceased. The three sons are on the ranch. Our subject affiliates with the K.O.T.M., of Heppner. Mrs. Finley is a member of the Christian church, of Athena, but she and all of the family attend the nearest point of worship, manifesting a liberal spirit free from sectarian bias. Mr. Finley enjoys the confidence and esteem of all the community and is considered one of the most substantial citizens of the county.

ALEXANDER K FINLEY -- The son of the earliest pioneers, a native of the west, a champion of the right, and a true American from start to finish, the man whose name stands at the head of this article is a citizen well worthy of a place in the chronicles of this county high in the roll of honor. His parents, R. C. and Polly Ann (Kirk) Finley, threaded the plains in an ox train three years before the excitement of '49. they settled in Linn county and built the first grist mill south of Oregon City. In the fall of 1848 his father started on horseback to the gold fields of California, arriving there on foot, as his horse gave out on the Pitt river. The next spring he returned via Portland with a thousand dollars of "dust" in his belt and settled on the old place, where he remained till the time of his death, in 1892, October 4.
Our subject was born in Linn County, on June 12, 1859, and lived there twenty years. During this time he acquired a common-school education and a good training on his father's farm. In the fall of 1878 he toured through the Palouse country for a home and then came to Umatilla county and took up a homestead and pre-emption where he now lives, four and one-half miles southeast from Helix. To this he has steadily been adding until now his realty holdings aggregate eight hundred acres, all excellent wheat land. With this mamouth estate to oversee he is yet enabled to operate four hundred acres more, making a grand total of twelve hundred acres of wheat. On this vast acreage he averages thirty-two bushels per acre each year through wise husbandry.
At Crawfordsville, Linn county, on January 28, 1878, Miss Isabelle, daughter of H. B. and Elizabeth (Ray) Derick, among the earliest pioneers of Umatilla county, and Mr. Finley were united in marriage, and to enhance their connubial bless the following children have graced the union: May, Robert, Nancy, Myrtle, Walter, Lloyd.
The quota of fine improvements have kept pace with the increase of his estate and commensurate with its generous proportions are the elegant residence, modern and commodious barn and numberous and substantial outbuildings that his taste has planned and executed in the finest manner. His political activity is well known and his forceful operations in that field testify that he is no pigmy in that arena. His sentiments are with the Prohibition party and his acts are with his sentiments. On that ticket he ran for county commissioner at the last election. He is a member of the Christian church at Helix and is active for its interests and in disseminating the truth, which, with his consisten and upright life, have made him a power for good in his community.

VAWTER, WILLIAM I., of Medford, president of the Jackson County Bank, was born in Linn County, March 24, 1863, and graduated from the University of Oregon in 1886. He was principal of the Eugene public schools till 1888, when he established the bank at Medford. He is an earnest Republican, has been a delegate to county and state conventions and league meetings, a member of the congressional and state central committees, and chairman of the county central committee.

WILLIAM I. VAWTER
Among the substantial institutions of southern Oregon is the Jackson County
Bank of Medford, which was established September 1, 1888, and was conducted
successfully as a private bank by William I. Vawter until July 1, 1892, when the
capital stock was increased from $25,000 to $50,000, and incorporated with the
following named officers: William I. Vawter, president; William Slinger,
vice-president; G. W. Howard, cashier; and J. E. Enyart as assistant cashier.
Exchanges drawn on Portland, San Francisco and New York. The bank has done a
safe and prosperous business since its doors were thrown open to the public and
it ranks among the substantial banking houses of the State.
William I. Vawter, whose name heads the official list, is a native of Linn
county, Oregon, born March 24, 1863. His father emigrated from Indiana across
the plains to Oregon, in 1853. His mother is a native of Missouri, and also
crossed the plains by ox teams, with her parents, as early as 1846. Her people
located in the Willamette valley, which at that early day was populated with
Indians.
William was reared and educated in his native State, graduating from the
university of the State in 1886, and filled the position of principal in the
public schools in Eugene, until 1888, when he established the Jackson County
Bank, at Medford.
Politically he is a stanch Republican, and takes an active interest in the
party. He is a member of A.F. & A.M. Since he became a resident of Medford, he
has been closely identified with the interests of that city, and is always among
the first to give his support, financially to every public enterprise tending to
develop the city. Although a young man, he has gained a reputation for himself
in the community as one of the most influential and progressive citizens, as
well as an able scholar and financier.

In this action plaintiffs Grace Finley and Velda Baird recovered a judgment against Frank G. Steiner, the driver of an automobile, and Dan Wray, his employer, for damages as the result of the death of Robert W. Finley, husband of Grace Finley and father of Velda Baird, he having died from injuries received while riding as a guest in the automobile of his father, Alexander K. Finley, when it collided with the automobile driven by the aforesaid Frank G. Steiner. The court found that the death of the decedent was occasioned by and through the concurrent negligence of the drivers of both automobiles and absolved the deceased of any contributory negligence. Judgment was accordingly rendered against defendants in favor of Grace Finley, the widow, for $12,500 general damages; $754 special damages, and in favor of the daughter, Velda Baird, in the sum of $1,000.
As to the other named plaintiffs, they are the surviving heirs of Isabel Finley, who was the wife of Alexander K. Finley. Mrs. Finley also was fatally injured in the same collision. As to her heirs, however, judgment went for the defendants on the ground that the contributory negligence of her husband, Alexander K. Finley, driver of one of the involved automobiles, was imputed to her. From the last-named judgment no appeal was taken, and we are therefore concerned only with the appeal from the judgment rendered in favor of the wife and daughter of Robert W. Finley.
The accident occurred at 1:30 on the afternoon of December 13, 1937, at the intersection of Nordhoff Street and Van {Page 40 Cal.App.2d 334} Nuys Boulevard in the San Fernando Valley section of the city of Los Angeles. The day was clear and the pavement dry. Both streets were paved and each was approximately 40 feet wide. Boulevard stop signs, requiring traffic on Nordhoff Street to stop before crossing Van Nuys Boulevard, had been authoritatively erected at the intersection pursuant to resolution of the city council, thereby establishing Van Nuys Boulevard as a "through highway". (Vehicle Code, secs. 82.5 and 471.) The vehicle operated by defendant Steiner was moving north on Van Nuys Boulevard when it struck the right side of the eastbound car driven by Alexander Finley as the latter crossed the intersection on Nordhoff Street. The court found that the Finley car did not stop before entering the intersection.
Frank G. Steiner, driver of defendant Wray's car, called by plaintiffs under section 2055 of the Code of Civil Procedure, testified that as he approached the intersection he was driving 25 to 30 miles per hour; that after coming almost to a stop at a railroad crossing six-tenths of a mile south of the intersection he accelerated to 25 or 30 miles per hour, and did not exceed that speed at any time; that he first saw the Finley car when he was about 35 feet from the south line of Nordhoff Street, at which time the Finley car was approximately 20 or 25 feet from the west line of Van Nuys Boulevard on the south or right side of Nordhoff and traveling 20 or 25 miles per hour; that thereupon Finley accelerated his car and Steiner applied his brakes and skidded-- moving straight ahead--until the impact, which occurred in the intersection 2 or 3 feet north of the south line of Nordhoff. According to the witness, his car stopped almost instantly after the impact and the front end slid to the right so that it came to rest pointing northeast, while the Finley car went on past the Steiner car, turned to the left into some shrubbery, then turned sharply to the right and overturned on its left side at the northeast corner of the intersection. Steiner suffered only a slight abrasion on his forehead.
Frank Jones testified that he was driving with Mrs. Jones north on Van Nuys Boulevard immediately before the accident happened; that as he crossed the railroad track six-tenths of a mile south of the intersection, a car passed him going north; that no other car passed him up to the time he reached the intersection. He further testified that after {Page 40 Cal.App.2d 335} slowing down for the crossing he accelerated to about 45 miles per hour; that he first observed there had been a collision when he had traveled two-thirds of the distance from the railroad crossing to the intersection. The witness' wife estimated the speed of the car that passed them as between 55 and 70 miles per hour as it moved ahead.
Alexander K. Finley testified that he brought the Finley car to a stop about 3 feet west of the west line of Van Nuys Boulevard, from which point he could see about 276 feet south on Van Nuys; that he did not see the other car until he had started up and had reached the middle of the street, when, he supposed, the other car was 33 feet away; he did not remember whether he looked down Van Nuys Boulevard again after starting up; that his estimate of defendants' speed as 80 miles per hour was based on "what they told me of the accident ..."; and admitted that at the taking of his deposition he testified, "I hadn't time to form any" (estimate of speed) "because it was done all at once." It also appeared that his testimony as to where he stopped before crossing Van Nuys Boulevard was founded on measurements taken by him after the accident based on his recollection of the distance he could see down Van Nuys Boulevard when he allegedly stopped.
A police officer testified that he and his partner were driving behind the Finley car and were about 150 feet away when the collision took place; that the Finley car did not stop but was going about 15 miles per hour as it reached the intersection and then increased speed slightly; that he formed no estimate of the speed of the other car; that before the cars were moved he and his fellow officer measured the skid marks of the defendants' car and found them to be 35 feet long and "practically straight" except the last two feet at the north end, where they curved to the east. The other officer testified that they saw the accident from about 75 yards from the intersection and that they measured the marks after the cars had been moved away. The defendant Steiner testified that he was going about 10 miles per hour at the moment of impact, and that the skid marks were measured from the front of his car and that they were between 24 and 25 feet. Walter Finley, a brother of decedent, testified that he "stepped off" the skid marks the day after the accident; that they were "approximately between" 60 and 75 feet long. A garageman called on behalf of plaintiffs testified that he {Page 40 Cal.App.2d 336} examined the Finley car after the accident and found that the right side of the frame was "bent in approximately five inches"; that the cross-members of the frame also "were bent to a certain extent".
Appellant's chief contention is that the findings are not supported by the evidence; that "the undisputed evidence shows that the defendants were not guilty of any negligence whatsoever"; that the findings that defendant Steiner was negligent and that his negligence was a proximate cause of the accident "are not supported by the evidence or any inference that may properly be drawn from the evidence"; and further, that "the sole proximate cause of the accident was the negligence of Alexander K. Finley. Any negligence on the part of the defendant Steiner, even if shown, was not a proximate or legal cause of the collision, and the court erred in so finding."
[1] It is true, as contended by appellants, that the burden rested upon the plaintiffs at the trial to prove the facts constituting negligence on the part of defendants. (Diamond v. Weyerhauser, 178 Cal. 540 [174 P. 38]; Tower v. Humboldt Transit Co., 176 Cal. 602 [169 P. 227]; Wood v. Los Angeles Ry. Corp., 172 Cal. 15 [155 P. 68].) Under the law, therefore, it devolves upon us to ascertain whether the findings as to negligence are substantially supported by the evidence, and if such evidentiary support is lacking we must reverse the judgment. (Houghton v. Loma Prieta Lbr. Co., 152 Cal. 574 [93 P. 377, 14 Ann. Cas. 1159, 14 L.R.A. (N. S.) 913]; Wynne v. Wynne, 20 Cal.App.2d 131 [66 PaCal.2d 467].)
[2] Defendant Steiner testified that as he crossed a railroad track six-tenths of a mile removed from the scene of the accident he came "almost to a stop"; that he then "went back to a speed of about 25 or 30 miles per hour up until directly before the accident". He further testified that he first observed the Finley vehicle when about 35 feet from the point of impact, and that the latter was then traveling about 20 to 25 miles per hour, but its speed was accelerated, whereupon, according to Mr. Steiner, he applied his brakes. In contradiction of defendant Steiner's testimony that he practically stopped at the railroad crossing six-tenths of a mile from the accident, we find the testimony of the witness Frank Jones, who with his wife was in an automobile traveling in the same direction as defendant Steiner. This witness {Page 40 Cal.App.2d 337} testified that before he reached the railroad crossing his automobile was going about 45 miles per hour; that he slowed down for the crossing and then increased his speed again to about 45 miles per hour. Mr. Jones further testified that at the time defendant Steiner's automobile passed him at the crossing it was traveling at a rate one-third faster than the Jones car. Mrs. Jones, who was riding with her husband, estimated the speed of the Steiner automobile as it passed them at the railroad crossing as between 55 and 70 miles per hour. Although there was a conflict in the evidence as to the length of the skid marks made by the defendant Steiner's automobile, there is in the record evidence that these skid marks were in a straight line and were from 60 to 75 feet in length. The record also reflects evidence that the defendant Steiner's automobile struck the Finley vehicle on the right side with such force that the right side of the frame was bent in five inches; the right rear door, composed of steel, was bent in six inches, while the edge of the steel floor on the right side was pushed up approximately six inches. [3] The trial judge was not compelled to accept defendant Steiner's estimate of his speed, but was entitled to infer from the length of the skid marks and the force of the impact, as well as the testimony of Mr. and Mrs. Jones, that his actual speed was greatly in excess of that to which he testified. In determining the credibility of the witness Steiner, the trial court was authorized to consider all of the facts and circumstances of the transaction and to believe the testimony of Mr. and Mrs. Jones in contradiction of that given by Steiner as to his speed when he was crossing and after he had crossed the railroad tracks a short distance from the scene of the accident. The court was authorized to disbelieve the testimony of defendant Steiner as to his speed at the time he crossed the intersection if the court believed his testimony was false as to the speed at which he claimed he was traveling when he passed the automobile of Mr. Jones at the railroad crossing.
Under all of the foregoing facts, we cannot say that the trial court erred in holding that defendant Steiner was unmindful of his duty to anticipate that he might meet vehicles at any point on the highway and particularly at intersections thereof, and that he failed to keep his machine under such control as would enable him to avoid a collision under the conditions here present. In other words, it was a question {Page 40 Cal.App.2d 338} for consideration by the trial court as a matter of fact to determine whether, under all the circumstances here present, including the physical facts, defendant Steiner was driving his automobile in conformity with the requirements of section 510 of the Vehicle Code. The testimony herein narrated presents substantial evidence to warrant the trial court in concluding as it did that defendant Steiner was not driving his car at a careful and prudent speed, not greater than was reasonable and proper, and at such speed as not to endanger the life, limb or property of any person. Therefore we cannot disturb the finding that such negligence on the part of defendant Steiner, concurring with the negligence of Alexander K. Finley, driver of the automobile in which decedent was riding, was the proximate cause of the collision. To do so would mean a substitution of the opinion of this court on the facts of the case for the opinion of the trial court with reference thereto, which, as we understand the rule applicable in the premises, is not in accord with the recognized functions of an appellate tribunal.
[4] Appellants' contention that inferences deducible from the evidence herein are dispelled as a matter of law by the positive testimony of defendant Steiner concerning the speed at which he was traveling, must fall before the rule which declares that inferences are not dispelled as a matter of law when the evidence in opposition to such inferences is weakened by improbabilities. (Engstrom v. Auburn Auto Sales Corp., 11 Cal.2d 64, 70 [77 PaCal.2d 1059].)
[5] No complaint is made by appellants of the award for funeral and burial expenses, and the main attack is centered upon the award of $12,500 to the widow of the deceased. In this connection the record discloses that Grace Finley was happily married to decedent for more than 34 years. He was 57 years of age at the time of his death and was in robust health. The husband was industrious and hard-working. At the time of his death he and his wife had been operating a service station and lunch counter on a mountain highway near Coeur d'Alene, Idaho, from which they were realizing $150 per month during the winter and $300 per month during the summer season, or, as testified, the profits ran as high as $300 per month for four or five months of the year and $150 for the remaining period of each year. Decedent had a life expectancy of l6 years. The widow testified that she assisted her husband in the operation of the service station {Page 40 Cal.App.2d 339} business; that she served lunches, helped pump gasoline, and waited upon the customers. She further testified that after her husband's death she found herself unable to operate the business alone and sold the same for $450.
[6] In actions of this type the recovery is limited to pecuniary loss and "such damages may be given as under all the circumstances of the case may be just". (Code Civ. Proc., sec. 377.) While damages recoverable are only for the pecuniary loss suffered, that loss includes the deprivation of the comfort, protection and society of the deceased (Clark v. Tulare Lake Dredging Co., 14 Cal.App. 414 [112 P. 564]); and loss of comfort, protection and society not only is a proper element of damages, but is by no means to be classed as compensable by merely nominal damages. (Johnson v. Southern Pac. R. Co., 154 Cal. 285 [97 P. 520].) It is true that the pecuniary loss suffered from the last-named cause is difficult to measure in mere dollars and cents, and therefore must, with the whole question of damages, be left to the good sense and sound discretion of the trial judge or jury, to be exercised in the light of all the circumstances of the case. [7] The power of an appellate court to control the amount of damages awarded arises only when the facts before it are such as to suggest passion, prejudice or corruption on the part of the trial court or jury making the award. (Morris v. Standard Oil Co., 188 Cal. 468 [205 P. 1073]; Bisinger v. Sacramento Lodge No. 6, 187 Cal. 578 [203 P. 768]; Hale v. San Bernardino etc. Co., 156 Cal. 713 [106 P. 83]; Webster v. Harris, 119 Cal.App. 46 [6 PaCal.2d 88].)
[8] With reference to the award of $1,000 to the decedent's daughter, the record shows that she was 34 years of age, married, and the mother of two small children. Her husband was working part time. During the 16 years of her married life she was the recipient of $100 each year from the decedent, which money was sent her to assist in the purchase of clothing and other necessities of life. With decedent's life expectancy of 16 years, an award of $1,000 cannot be regarded as excessive. After a review of the decisions of appellate courts of this state in similar cases, we cannot hold that the damages awarded in this case were excessive, nor can we say, under all the facts and circumstances here present, that the damages are so outrageously excessive as to suggest at first blush passion, prejudice or corruption. {Page 40 Cal.App.2d 340} Therefore they cannot be set aside on appeal. (Conner v. Henderson, 108 Cal.App. 237, 242 [291 P. 641].)
For the foregoing reasons, that part of the judgment from which this appeal is taken must be, and it is, affirmed.

VERNON HILL VAWTER
Vernon Hill Vawter, cashier of the Jackson County Bank of Medford and its
chief executive, is not only prominently associated with business interests and
enterprises which have much to do with the upbuilding of the city, but has in
many other ways manifested his public spirit through cooperation with projects
of great benefit to the state. He now has the distinction of serving as the
youngest member of the board of regents of the State University and his labors
are at all times a direct and constructive element of public progress. Mr.
Vawter is numbered among the native sons of Medford, his birth having occurred
November 13, 1890, his parents being William I. and Etta M. (Hill) Vawter. The
father was also a native of Linn county and the members of the family rank high
as factors in the growth and progress of southern Oregon. The first American
ancestors of the Vawter family came from England more than a hundred years ago.
William I. Vawter has the credit of being the "father of banking" in Medford and
his fame is not confined alone to this field of activity, for his memory is
cherished as that of one of the potential builders of the town, his efforts
contributing in substantial measure in many ways to the early progress and later
improvements of the city.
Vernon H. Vawter was educated in the graded and high schools of Medford and
in the University of Oregon. Following his graduation from the state
institution he returned to Medford and accepted a position in the Jackson County
Bank, of which his father was then president. The son is now the cashier of the
bank and its chief executive, contributing much to its development and growth.
In fact under his guidance the bank has come to be regarded as one of the most
substantial financial institutions of the state.
During the World war Mr. Vawter was accepted in a civilian Officers'
Training Camp, but returned home incapacitated as a result of a severe attack of
influenza and before he had recovered his health the armistice was signed. No
man of his age in Oregon occupies a more prominent place in the business life of
the state than does he. As a leading citizen of Medford he is called to act on
every public service committee and he cheerfully responds to all demands made
upon his time and means. He has had an unusual honor bestowed upon him in that
he has been selected as one of the regents of the University of Oregon, enjoying
the distinction of being the only man of his years who has ever been so highly
honored. He is a member of the Medford public library board and belongs to the
Chamber of Commerce, of which he served as president, cooperating in all of its
activities for the benefit and upbuilding of the city. His political allegiance
is given to the republican party, and he steadily declines to become a candidate
for office.
In 1915 Mr. Vawter was married to Miss Aletha Emerick of Boise, Idaho, a
daughter of V. J. Everick, one of the most prominent residents of the city, who
for two terms served as mayor of Medford.
Mr. Vawter is the treasurer of the Elks lodge of Medford and is also the
treasurer of the Big Bend Milling Company, which has constructed in Medford
several of its best business blocks on Main street and Central avenue, North.
Nor does Mr. Vawter selfishly confine his energies to the growth and improvement
of the city in which he makes his home, but takes an active interest in all
matters for the benefit of the state. He is now one of the committee engaged in
improving Crater Lake and the Crater Lake National Park. Progress and
enterprise are the keynotes of his character and have constituted the forces
that have thrown open for him the portals of success.

BOWLIN, Robertta Rose
Born August 31, 1921 went to be with our Lord on June 11, 2007. Born in Sunset, WA to Alfred and Blanche Price. Survived by one daughter, Mary Ellen (Neil) Dunagan and one son, Robert A. (Audrey) Bowlin. Six sisters and four brothers. 10 Grandchildren, 12 Great-Grandchildren and five Great-Great-Grandchildren and numerous nephews and nieces. Proceeded in death by husband, Lloyd, Grandsons' Michael and David, Granddaughter Colleen, Great-Grandson Lane and Great-Great-Grandson Nathaniel. Lloyd and Roberta lived and raised their family in Hooper, WA while Lloyd worked for McGregor's Land and Live Stock. The couple then spent their retirement years in LaCrosse, WA. The last six years Robertta lived in Spokane, WA with her daughter and family. Bobbie's favorite past times were reading the Lord's Word, knitting and playing five or six handed pinochle. She will be greatly missed by all of the ones who loved and cared for her dearly. Graveside services will be held on Friday, June 22, 2007 at 10:00 a.m. at the cemetery in LaCrosse, WA. There will also be a Memorial Service at Opportunity Presbyterian Church 202 North Pines Road Spokane Valley, WA. on Sunday, June 24, 2007 at 2:00 p.m. The Rev. Susie Beil will be officiating both services. All are welcome at both services. Memorial gifts can be made to Opportunity Presbyterian Church or Hospice of Spokane.
